Trademark registration means that in order to obtain the exclusive right to use the trademark, the trademark owner uses or intends to use the trademark, in accordance with the registration regulations, principles and procedures prescribed by the state, the trademark owner submits an application for registration of used mark or intention of use mark to the Trademark Office of the State Intellectual Property Office, and has been reviewed by the Trademark Office for the decision whether approve registration and grant trademark applicant exclusive rights to their trademarks. Exclusive rights are protected by PRC laws. Trademark owners have the right to administer their registered trademarks and prohibit others from infringing upon them, including trademark registrants’ exclusive rights to use their registered trademarks, profit rights, disposition rights, renewal rights and prohibiting others Infringement of rights.         Object of Trademark Registration and Protection

         A trademark is composed of words, graphics, letters, numbers, three-dimensional signs, color combinations, sounds, or a combination of the above elements. The common ones are word marks, graphic marks and combination marks. It is suggested here that if you want to register a trademark, it is recommended to separate the combination marks with both graphics and words. This will not only have a high success rate, but also can be used separately to obtain protection.

        Trademarks are divided into registered trademarks and unregistered trademarks in terms of whether they have legal protection. Trademarks in China are registered and protected according to categories. According to the Nice classification, there are a total of 45 categories. If you want to obtain protection for which category, you should register the products in the corresponding category.

           

        Qualification certificate of trademark applicant:

        ●  Apply in the name of the company, with a copy of the business license attached;

        ● Apply in the name of an individual with a copy of ID card or passport.

        ● Trademark design: The picture is 5-10 cm long and 5-10 cm wide, electronic file in JPG format.

        ●  Proof of priority: If you have priority according to the Paris Convention, please list the goods or services involved in the priority and relevant certificates in detail. The right of priority is granted within six months of the application.

        ●  List the goods or services that are seeking registration, and point out the trademark category. All goods or services must be listed in strict accordance with the trademark classification table. Please contact us for trademark classification.

         

        Trademark registration application agency process

         ●   After receiving the trademark drawings and registered product information provided by you, our firm can provide analysis and query services;

        ● After completing the necessary documents for registration and paying the registration fee, submit the registration application entrusted by the customer to the Trademark Office of the State Administration for Industry and Commerce;

        The process of Trademark registration application

        ●  Submit application (1-3 days): prepare trademark registration application materials, including the name of the trademark, the goods or services to be registered, the applicant’s qualification certificate, and the power of attorney authorized to agent  for trademark registration;

        ●  Formal examination (approximately 20 days): The Trademark Office will check whether the documents and procedures for applying for trademark registration comply with the legal provisions. If they comply with the legal provisions, the examination agency shall set the application number, determine the application date, and issue the "Trademark Registration Application Acceptance Notice"

        ●  Substantive examination (approximately 6-8 months): Check, data search, analysis and comparison conducted by the Trademark Office on whether the trademark registration application complies with the provisions of the Trademark Law (trademark prohibition clauses, non-significant, similar trademarks, etc.) , Investigate and research and decide to give a series of activities such as preliminary approval or rejection of the application;

        ●  Announcement of the preliminary examination (3 months): The announcement of the preliminary examination of the trademark refers to the decision to allow the registration of trademarks in compliance with the relevant provisions of the "Trademark Law" after the examination of the trademark registration application, and shall be announced in the "Trademark Bulletin";

        ● Obtaining the registration certificate (approximately 1 month): If no one raises an objection to the preliminarily approved trademark three months after the publication of the preliminary approval announcement, the trademark shall be registered and the registration announcement shall be published at the same time. If no one raises an objection within three months or the objection is ruled to be untenable, the registration of the trademark will take effect and the registration certificate will be issued.

 

        Term of protection for registered trademarks

         The term of protection of trademark rights is 10 years. Trademark renewal can be applied for within 1 year before the expiration. After the renewal is successful, the protection will continue for 10 years.
