Road Accident

HI, I was runover by a car outside the Nanjing train station. My leg was crushed against the hotels car that I had just got out of. I was in hospital in China for 5 days and had an operation to stabilise my leg before flying home. I have had 2 more operations in the UK and I am about to have my next operation in a few weeks. The acident was reported to the police and the driver was arrested. We have photos of the cars involved with car registration numbers. This accident happened on 19th Novemver 2013. Is it possible to sue the driver? have I left it to late to sue the driver? Many Thanks Michelle Tomkins
