Who can file divorce petition in China?

There are three main categories of married couples that 
can file divorce petition in China:

1,  Divorce between a foreign citizen and a Chinese citizen 

A foreign national who married a Chinese woman/man in China can get a divorce in China no matter they are both currently living domestically or abroad. 

2,  Divorce between two foreign citizens working or living in China now

Expats, married either in China or in another country, can apply divorce petition in our people’s court provided they can reach the consensus to be bound by judgment issued by our Chinese judge in accordance with our marriage and family law of PRC.

3,  Divorce between two Chinese citizens

That will be definitely acceptable for chinese couples married in Mainland China can got to our Chinese court for divorce in China even if they are currently living abroad.
